The work includes providing all labor, materials, machinery, tools, equipment and other means of construction necessary and incidental to the completion of the work shown on the plans and described in these specifications including, but not necessarily limited to the following:

Removal of the existing culvert, replacement with a new concrete box culvert, and associated highway approach work and stream work. Construction will be on a new alignment slightly shifted east of the existing alignment with an off-site detour to maintain traffic during construction.

The forgoing is a general outline of work only and shall not be construed as a complete description of the work to be performed under the Contract.

This is a State Aid Project and NYSDOT Standard Specifications, officially finalized and adopted on January 1, 2024 as posted on the New York State Department of Transportation’s website must be followed by the successful bidder.

No residential or geographical restrictions will be in effect for this project.

Copies of the Contract Documents (a flash drive containing the Contract Documents) may be obtained in person at the following location upon payment of $25.00 (by non-refundable check, made payable to Wyoming County Highway Department) for each set of documents requested:

Contract Documents may be mailed (book rate) to prospective bidders upon request.  A separate check of $15.00 (made payable to Wyoming County Highway Department) is required to cover postage.  Contract Documents will not be mailed until payment is received by the County.  Only those who have purchased Contract Documents will be provided addenda.

No questions or inquiries regarding this bid will be accepted within three (3) business days prior to the bid opening.

Contractors that obtain Contract Documents from a source other than the issuing office must notify the issuing office in order to be placed on the official Plan Holder List, to receive Addenda and any other Bid correspondence.  Bids received from Contractors other than those on the official Plan Holders List will not be accepted.

Addenda will be emailed from LaBella Associates to Bidders listed on the official Plan Holders List.  An emailed response from the Bidder, to the Addendum sent by LaBella Associates will act as proof that the Bidder received the Addendum.  In addition to an emailed response, Bidders must acknowledge receipt of all Addenda by signing and dating each Addendum and the Acknowledgement of Receipt of Addenda on the Contact Proposal Form.  Failure of any Bidder to receive any such Addendum or interpretation shall not relieve such Bidder from any obligation under this Bid submittal.  All Addenda so issued shall become part of the Contract Documents.

Bidders shall promptly notify Wayne A. Frye of any errors, omissions, conflicts or ambiguity within the Contract Documents within 5 days of bid opening.

All bids must include the completed Bid Form, Non-Collusive Bidding and Disbarment Certifications, MBE, WBE and SDVOB Commitment Form, and Lobbying Certifications. This is a unit price bid as described in the Instructions to Bidders. No bidder may withdraw his/her bid within forty-five (45) calendar days after the actual date of the opening thereof. 

Each bid must be accompanied by security in an amount not less than five percent (5%) of the amount of the bid in the form and subject to the conditions provided in the Instructions to Bidders.

Bids to be considered must be received in a sealed envelope at Wyoming County Highway Department, 4328 State Route 19, Rock Glen, NY 14550 by 3:00pm, local time, on Thursday, March 14, 2024 at which time they will be publicly opened and read aloud.  Bids received after the above noted time will not be accepted.  All sealed bids must be received in separate sealed envelopes addressed to the Wyoming County Superintendent of Highways. All sealed envelopes should be clearly labeled “BID FOR REPLACEMENT OF SILVER LAKE ROAD (CR 22) CULVERT OVER SILVER LAKE OUTLET”.

The Bidder to whom the Contract is awarded will be required to furnish Performance, Payment and Guarantee Bonds from an acceptable Surety Company for an amount not less than 100% of the accepted bid. The successful Bidder and all subcontractors must have an approved CCA-2 on file with NYSDOT prior to being awarded a contract. If the successful Bidder does not currently have a CCA-2 on file with NYSDOT, the Bidder may find the CCA-2 forms and instruction for completion online at https://osc.state.ny.us/venrep/form_cca2.htm.

The successful Bidder will be required to comply with all provisions of the Federal Government Equal Employment Opportunity clauses issued by the Secretary of Labor on May 2, 1968 and published in the Federal Register (41 CFR Part 60-1, 33 F.2 7804). Successful bidders will be required to pay prevailing wage rates on this contract.

Wyoming County is exempt under Section 1116 of the New York State Tax Law, and therefore, no sales tax shall be included in the bid.

Wyoming County reserves the right to consider the bids for forty-five (45) days after receipt before awarding any Contract, and to waive any minor informalities in, and to reject, any and all bids. All bids are subject to final review and approval by the Wyoming County Board of Supervisors before any award of contract may be made. Receipt of bids by Wyoming County shall not be construed as authority to bind Wyoming County.

A Notice to Proceed will be issued for all work no later than May 27, 2024. Substantial Completion of all work, with the exception of any miscellaneous items generated by a punch-list walk thru, shall occur within one hundred and forty (140) consecutive calendar days from the Notice to Proceed. Final Completion, including all punch list items, finish activities, and removal of all work zone traffic control shall occur within one hundred and forty seven (147) consecutive calendar days from the Notice to Proceed.
