AL Tech Specialty Steel Corp., OU3 On-Site Structures


Sealed Bids for the AL Tech Specialty Steel Corp., OU3 On-Site Structures, project will be received by the New York State Department of Environmental Conservation, Division of Management and Budget Services, Bureau of Expenditures, 625 Broadway, 10th Floor, Albany, New York, 12233-5027, until the time of 1:00 PM, Eastern Standard Time, on the date of Tuesday, October 13, 2020. Timely Bids will be publicly opened and read aloud at the above time and date. Governor Cuomo’s Executive Order 202.11 allows for the non-public opening of Bids; provided, however, that, where practical, public entities shall record or live stream the Bid opening so that the public has the opportunity to view such Bid openings. The Department reserves such right if conditions require a non-public Bid opening. Electronically transferred Bids will not be accepted.

NYSDEC considers this to be essential construction under Governor Cuomo’s Executive Order 202.6. NYSDEC has developed guidance concerning our determination of essential construction activities under Executive Order 202.6 for the Brownfield, Superfund and Spill Response programs. The advertised project involves the implementation of remedial activities selected for Operable Unit No. 3 - On-Site Structures at the AL Tech Specialty Steel Corp. site located in the Town of Colonie, Albany County, New York. Remedial activities include, but are not limited to, characterization, cleaning, demolition and offsite disposal of 22 primary industrial steel-making structures and appurtenances. Additional removals shall include ancillary structures such as the clarifier tank, lime storage tanks, above ground storage tanks, underground storage tanks, support sheds, utility poles, concrete barricades with and without bollards, secondary concrete containment structures and substation transformer racks. Water present in vaults, pits or other subgrade structures shall be evacuated and treated prior to discharge to a Department-provided outfall. Restoration of the site shall follow removal of structures.

The estimated value of this work is between $15,000,000.00 and $20,000,000.00.

In addition to the documents mentioned above, the Department is providing Bidders, through the aforementioned FTP link, with high-resolution aerial imagery of the site viewable by use of a third-party software. Bidders interested in viewing the imagery can do so by; registering an account and downloading the viewer for free from Bentley ContextCapture Viewer, and downloading the AL Tech Oblique Imagery file from the FTP site. The Department does not endorse or require use of Bentley products and will not provide technical support. Use is at the risk of the Registrant and subject to any and all user and/or licensing agreements which may be imposed by or afforded to Bentley, its parent or subsidiary companies. The Department is providing this imagery for informational purposes only and does not guarantee accuracy of representation or measurements which may be made by a potential Bidder using the viewer and data file.   

Proposals will be accepted only from Bidders who attend the Pre-Bid Conference. All Proposals must be made on the Bid Form(s) provided in the Contract Documents, and thereafter enclosed in the envelope which will be provided by the Department at the Pre-Bid Conference. Each Proposal must be accompanied by a Deposit or Bid Bond in the amount of five percent (5%) of Proposer’s Bid amount. All Bidders must attend the Pre-Bid Conference to receive special requirements and/or instruction for the Contract. The Pre-Bid Conference will be held on Wednesday, August 19, 2020 and an additional Pre-bid conference will now be held on Wednesday September 9th at 10:00 AM. Bidders are required to attend only one Pre-Bid meeting at the AL Tech Specialty Steel Corp. site located at the intersection of Lincoln Ave. and Spring St. Rd., Town of Colonie (Watervliet), New York. The site is entered from Lincoln Ave.

Attendees must pre-register for a Pre-Bid Conference by emailing the DEC Project Manager, Benjamin Rung at Please provide name(s) of attendee, company represented, contact information and indicate preferred Pre-Bid Conference session. Efforts will be made to accommodate preferred time; however, group sizing is paramount and some attendees may be asked to join the alternate gathering. 

Attendees must be OSHA 40-hour HAZWOPER (29 CFR 1910.120) certified to enter upon the site for participation in the Pre-Bid Conference and tour. Level-D PPE will be required at a minimum to participate in the site tour.

Due to conditions present at the site, the following additional equipment is recommended for the site tour:

  • A powerful flashlight,
  • Sturdy comfortable footwear; a comprehensive tour of the site will take two or more hours,

Attendees are encouraged to review the New York State Department of Health Information on Novel Coronavirus. Attendees travelling to the Pre-Bid Conference from outside of New York State shall review and self-implement restrictions or requirements which may be in place at the time of travel. Current travel advisories and restrictions can be found at NYSDOH Covid-19 Travel Advisory. It is the responsibility of the traveler to adhere to New York State guidelines and restrictions.

In order to reduce the Coronavirus risk at this project site during the Pre-Bid Conference all attendees are requested to adhere to the following guidelines at a minimum:

Implement social distancing such as not shaking hands and maintaining a distance of at least six (6) feet from other attendees. Per Executive Order 202.17, any individual who is over age two and able to medically tolerate a face-covering shall be required to cover their nose and mouth with a mask or cloth face-covering when in a public place and unable to maintain, or when not maintaining, social distance.

Given the increased potential for virus transmission at group events, we ask that you respect the following access restrictions when attending or sending representatives to the Pre-Bid Conference:

  • Do NOT travel to this site if you are experiencing flu-like symptoms including but not limited to fever, chills, cough, sore throat, diarrhea, vomiting, runny or stuffy nose, muscle or body aches, headaches, fatigue;
  • Do NOT travel to this site if, within 14 days of attendance, you have travelled for business or pleasure to a CDC-restricted location including: Brazil, China, Iran, most European Countries, United Kingdom and Ireland. Current guidance can be found at CDC COVID-19 Travel Recommendations by County;
  • Do NOT travel to this site if, within 14 days of attendance, you have been in direct contact with a person diagnosed with COVID-19 or suspected of having COVID-19.

Bidders should make every effort to send only one (1) representative to the Pre-Bid Conference, but in no case will more than two (2) representatives be allowed to participate in the Pre- Bid Conference.
