NOTICE TO BIDDERS

Sealed Proposals, invited by the County of Nassau, will be received by the County Executive of Nassau County, in the office of the Clerk of the Nassau County Legislature, Room 117, in the Theodore Roosevelt Executive and Legislative Building, 1550 Franklin Avenue, Mineola, New York, on Tuesday, October 28^th, 2025 until 10:30 AM, at which time the Proposals where accompanied with and presented separate from the required Bid Security will be publicly opened and read aloud, in the Meeting Room of the Nassau County Legislature, and the contract awarded as soon thereafter as practicable for:

 Nassau County Priority Resurfacing of Various Roads – Phase 16

Contract No. H61587-PR16

The proposed roadways to be resurfaced under this contract may include but not be limited to the following:

Bates Road from NYC Line to +/- 350 ft e/o Links Dr,

Covert Avenue from Monroe St to LIRR south of North Ave,

Feeks Lane from Bayville Rd to +/-235 ft. e/o Factory Pond Rd,

Harbor Hill Road from Roslyn Rd to Glen Cove Rd,

Ludlam Avenue from Bayville Bridge to Bayville Ave,

New Hyde Park Road from Jericho Tpk (NY25) to Union Tpk,

Roslyn Road from Church St to +/- 300 ft. s/o Harbor Hill Rd,

Searingtown Road from I.U. Willets Rd to LIE No. Service Rd,

Searingtown Road from Harrow Ln to 300 ft n/o Village Rd,

Shelter Rock Road from LIE No. Service Rd to Northern Blvd (NY25A),

South Avenue from Rockaway Ave to +/- 600 ft. n/o Rockaway Ave,

Stewart Avenue from Covert Ave to New Hyde Park Rd,

Weir Lane from Forest Ave to Skunks Misery Rd.

The work includes labor, materials, tools, equipment and incidentals as specified for the resurfacing of asphalt and/or concrete surfaces and other related work at various locations in Nassau County.

All questions regarding this contract shall be submitted via email prior to 4:00 PM on Friday, October 10^th, 2025, to Daniel Wong at dwong@nassaucountyny.gov.

No interpretation of the meaning of the Drawings, Specifications or other Contract Documents will be made to any Bidder orally.  Prospective bidders must request in writing such an interpretation from the Commissioner and such interpretation will be given in writing in the form of written addenda, to all prospective bidders, in accordance with the Instructions to Bidders, Item G.

This Contract will be subject to Nassau County Local Laws No. 14-2002, “Participation by Minority Group Members and Women in Nassau County Contracts,” which requires submission of a Utilization plan prior to the award of a County contract, No. 2-2016, “Participation of Service-Disabled Veterans in County Contracts,” and No. 9-2002, as amended by No. 3-2015, which require that firms entering into contracts with Nassau County must participate in registered and approved apprenticeship training programs unless such requirement are supplanted by requirements specified in the bidding instructions. At the time of bid submission, the Contractor shall submit, as part of its bid, documents in compliance with Title 51 of the Nassau County Miscellaneous Laws demonstrating participation in approved apprenticeship training programs that are appropriate for the type and scope of work to be performed pursuant to the Contract. Such apprenticeship training programs appropriate for the scope of this Contract shall include, but are not limited to the following: Laborers, Electricians, Carpenter, Operating Engineer, and/or any other trade appropriate for the type of work proposed. The apprenticeship training programs shall be registered with, and approved by, the New York State Commissioner of Labor in accordance with Article 23 of the New York State Labor Law. Note that if the Contractor does not comply with these requirements, the Commissioner may declare the Contractor's bid proposal non-responsive and award the Contract to the next lowest responsible Bidder.

Instructions to Bidders, Form of Bid Bond, Proposal, Form of Agreement, Specifications and the Plans, herein called the “Contract Documents”, may be examined at the Permit Office of the Department of Public Works, first floor, 1194 Prospect Avenue, Westbury, Nassau County, New York, 11590-2723, Phone No. (516) 571-6840, from 9:00 AM on Friday, September 26^th, 2025 until 3:45 PM on Friday October 24^th, 2025 (closed from 12:00 Noon to 1:00 PM, and on County Holidays). Copies of the Bid Contract Documents for use in bidding will be available for purchase at the Permit Office. In order to submit a bid, a non-refundable fee of $300.00 by check or money order, payable to the Nassau County Treasurer, will be required for each set of Bid Contract Documents purchased from the Permit Office.  Prospective bidders requesting Contract Documents by mail must remit an additional, non-refundable, fee of $30.00 per set to cover handling and first-class mailing.

ONLY BID CONTRACT DOCUMENTS PURCHASED FROM THE PERMIT OFFICE IN THIS MANNER WILL BE ACCEPTED/CONSIDERED.

Vendors doing business with Nassau County, including those responding to this solicitation, must register with the County. The Nassau County Bid Solicitation Boards are open to all registered vendors. Vendors that have not registered are able to view open solicitation opportunities, but they are not able to download solicitation documents or submit bids or proposals.

SUBCONTRACTOR LISTS - In accordance with GML § 101, for projects (1) to which a project labor agreement applies, (Labor Law Section 222) and, additionally, (2) on a public work contract for which separate specifications have not been prepared, each Bidder shall submit with its bid a separate sealed list on the forms provided with the proposal forms that names each subcontractor (for the enumerated work, if applicable) that the Bidder intends to use to perform work on the contract. Notwithstanding the forgoing, all subcontractors must be approved by the Commissioner in writing prior to such subcontractor’s performance of any work.

MWBE UTILIZATION PLAN – In accordance with Title 53, Nassau County Local Law No. 14-2002, all Vendors shall submit a MWBE Utilization Plan with their Proposal.

All Vendors shall submit a Completed Appendix C: Offeror’s Affirmation of Understanding of and Agreement Pursuant to State Finance law § 139-j(3) and § 139-j(6)(b).

IMPORTANT INFORMATION FOR BIDDERS

Effective immediately, no Contractor may submit a bid for public work in New York State unless they are registered with the NYS Department of Labor. Bids received from unregistered

Contractors shall be deemed non-responsive. Additionally, no Subcontractor may commence work on a public work project unless they are registered with the NYS Department of Labor. Security for Bid as set forth herein must be presented with the Bid.

“FAILURE TO PROVIDE THE REQUIRED SECURITY WILL RENDER THE BIDDER NON- RESPONSIVE AND THE BID WILL NOT BE ACCEPTED, OPENED OR READ ALOUD. IN ADDITION, FAILURE TO PROVIDE THE REQUIRED SUBCONTRACTOR INFORMATION AT THE TIME OF BID OPENING MAY RENDER THE BIDDER NON- RESPONSIVE”.
