Request for Annual Statement of Qualifications/Procurement of Engineering ServicesDescription: Consistent with Section 136-a of the State Finance Law, the Hudson River – Black River Regulating District requests your submission of an annual Statement of Qualifications and performance data. It is the Regulating District’s intent to maintain annually updated Statements of Qualifications (SOQ) in the event that the Regulating District has the need to hire an engineering consultant, and for the purpose of identifying and selecting professional firms on an as-needed or project specific basis, and to identify the most highly qualified firm to provide the project-specific services required. No award will be made because of this solicitation. A firm which submitted an Annual Statement of Qualifications in response to a previous Regulating District Request for Annual Statement of Qualifications may choose to append any new or additional information to its previous submission rather than resubmitting duplicate material. Submission Requirements Statements of Qualifications shall highlight the professional firm’s qualifications and experience in the following areas as they pertain to concrete and earthen dams, spillways, outlet structures, and reservoirs:
The Statement of Qualifications of firms demonstrating qualifications and experience in any of the areas listed above will be maintained in the Regulating District files. Please submit one (1) electronic copy by May 17, 2024. Evaluation and Selection Process in the Event of a Need to Procure Engineering or Surveying Services The following procedure will be used if the Regulating District identifies a need to procure engineering or survey services. For each professional engineering or survey service need, the Regulating District will evaluate Statement of Qualifications which are held on-file in the Regulating District office and based on criteria established by the Regulating District, identify no less than three professional firms deemed to be the most highly qualified to complete the engineering service needed, respectively. Upon identification of no less than three professional firms deemed to be the most highly qualified, the Regulating District will complete an additional evaluation of qualifications of the three professional firms to identify the highest qualified firm. The Regulating District will negotiate a contract with the highest qualified firm for engineering services, at a fee which the Regulating District determines to be fair and reasonable to the State of New York. If the Regulating District is unable to negotiate a satisfactory contract with the professional firm considered to be the highest qualified at a fee the Regulating District determines to be fair and reasonable to the State of New York, negotiations with that professional firm shall be formally terminated. The Regulating District will then undertake negotiations with the second most qualified professional firm. Failing accord with the second most qualified professional firm, the Regulating District will formally terminate negotiations. The Regulating District will then undertake negotiations with the third most qualified professional firm. Should the Regulating District be unable to negotiate a satisfactory contract with any of the selected professional firms, it will select additional professional firms in order of their competence and qualifications and will continue negotiations in accordance with this process until an agreement is reached. General Requirements for Contracting with New York State This solicitation for qualifications is subject to the New York State Finance Law §§ 139-j and 139-k, aka the Lobbying Law. Therefore, vendors are cautioned that the only permissible contacts for this qualification are the persons listed below. Failure to comply with this requirement can range from no contract award to debarment from sales to any NYS Agency. Successful contractors will be required to complete and submit documents related to Vendor Responsibility, NYS Finance Law § 139 j & k, and the New York State Tax Law Section, as well as other documents, as needed. The Offeror shall be considered unresponsive if it fails to comply with document submission requirements and shall be considered just cause to disqualify the Offeror from consideration.
