SUPPLEMENTAL NOTICE TO BIDDERS

Sealed Proposals, invited by the County of Nassau, will be received by the County Executive of Nassau County, in the office of the Clerk of the Nassau County Legislature, Room 117, in the Theodore Roosevelt Executive and Legislative Building, 1550 Franklin Avenue, Mineola, New York, on Tuesday, May 20, 2025 until 10:30 AM, at which time the Proposals where accompanied with and presented separate from the required Bid Security will be publicly opened and read aloud, in the Meeting Room of the Nassau County Legislature, and the contract awarded as soon thereafter as practicable for: 

NASSAU COUNTY DEPARTMENT OF PUBLIC WORKS CAPITAL PROJECT 3C067 

CEDAR CREEK OCEAN OUTFALL DIFFUSER MODIFICATIONS 

CONTRACT NO.: S3C067-22G– GENERAL CONSTRUCTION

The Cedar Creek Ocean Outfall Diffuser Modification Project is located at the discharge point of the Cedar Creek Wastewater Pollution Control Plant, an ocean outfall approximately 2.5 miles offshore from Jones Beach in the Atlantic Ocean, Nassau County, New York. The scope of work includes the interior cleaning of the existing diffuser header system and diffuser riser pipes; cleaning of the entire perimeter of existing riser pipes from existing joint to sea floor; removal, and replacement of portions of the riser pipes, and installation of duckbill check valves at the outlet ports where effluent flows into the surrounding waters. The project includes all labor, material, and equipment necessary or required to complete the work in accordance with and as described in the Contract Documents. Your bid shall be based upon a Notice to Proceed to be issued in the second quarter of 2026.

All questions regarding this contract shall be submitted via email prior to 4:00 PM on Friday, April 25, 2025, to Christopher Vella, at cvella@nassaucountyny.gov.

No interpretation of the meaning of the Drawings, Specifications or other Contract Documents will be made to any Bidder orally. Prospective bidders must request in writing such an interpretation from the Commissioner and such interpretation will be given in writing in the form of written addenda, to all prospective bidders, in accordance with the Instructions to Bidders, Item G.

This Contract will be subject to Nassau County Local Laws No. 14-2002, “Participation by Minority Group Members and Women in Nassau County Contracts,” which requires submission of a Utilization plan prior to the award of a County contract, No. 2-2016, “Participation of Service-Disabled Veterans in County Contracts,” and No. 9-2002, as amended by No. 3-2015, which require that firms entering into contracts with Nassau County must participate in registered and approved apprenticeship training programs unless such requirement are supplanted by requirements specified in the bidding instructions. At the time of bid submission, the Contractor shall submit, as part of its bid, documents in compliance with Title 51 of the Nassau County Miscellaneous Laws demonstrating participation in approved apprenticeship training programs that are appropriate for the type and scope of work to be performed pursuant to the Contract. Such apprenticeship training programs appropriate for the scope of this Contract shall include, but are not limited to the following: Laborers, Electricians, Plumber, Carpenter, Operating Engineer, and/or any other trade appropriate for the type of work proposed. The apprenticeship training programs shall be registered with, and approved by, the New York State Commissioner of Labor in accordance with Article 23 of the New York State Labor Law. Note that if the Contractor does not comply with these requirements, the Commissioner may declare the Contractor's bid proposal non-responsive and award the Contract to the next lowest responsible Bidder.

Instructions to Bidders, Form of Bid Bond, Proposal, Form of Agreement, Specifications and the Plans, herein called the “Contract Documents”, may be examined at the Permit Office of the Department of Public Works, first floor, 1194 Prospect Avenue, Westbury, Nassau County, New York, 11590-2723, Phone No. (516) 571-6840, from 9:00 AM on April 11, 2025 until 3:45 PM on May 9, 2025 (closed from 12:00 Noon to 1:00 PM, and on County Holidays). Copies of the Bid Contract Documents for use in bidding will be available for purchase at the Permit Office. In order to submit a bid, a non-refundable fee of $300.00 by check or money order, payable to the Nassau County Treasurer, will be required for each set of Bid Contract Documents purchased from the Permit Office. Prospective bidders requesting Contract Documents by mail must remit an additional, non-refundable, fee of $30.00 per set to cover handling and first-class mailing.

ONLY BID CONTRACT DOCUMENTS PURCHASED FROM THE PERMIT OFFICE IN THIS MANNER WILL BE ACCEPTED/CONSIDERED.

This project requires 20% Minority/ Women – owned Business Enterprises (MWBE) and 6% Service Disabled Veterans Owned Businesses (SDVOB) Good Faith Effort participation.

Vendors doing business with Nassau County, including those responding to this solicitation, must register with the County. The Nassau County Bid Solicitation Boards are open to all registered vendors. Vendors that have not registered are able to view open solicitation opportunities, but they are not able to download solicitation documents or submit bids or proposals.

IMPORTANT INFORMATION FOR BIDDERS

Effective immediately, no Contractor may submit a bid for public work in New York State unless they are registered with the NYS Department of Labor. Bids received from unregistered Contractors shall be deemed non-responsive. Additionally, no Subcontractor may commence workon a public work project unless they are registered with the NYS Department of Labor. SUBCONTRACTOR LISTS - In accordance with GML § 101, for projects (1) to which a project labor agreement applies, (Labor Law Section 222) and, additionally, (2) on a public work contract for which separate specifications have not been prepared, each Bidder shall submit with its bid a separate sealed list on the forms provided with the proposal forms that names each subcontractor (for the enumerated work, if applicable) that the Bidder intends to use to perform work on the contract. Notwithstanding the forgoing, all subcontractors must be approved by the Commissioner in writing prior to such subcontractor’s performance of any work.

MWBE UTILIZATION PLAN – In accordance with Title 53, Nassau County Local Law No. 14- 2002, all Vendors shall submit a MWBE Utilization Plan with their Proposal.

Security for Bid as set forth herein must be presented with the Bid.

“FAILURE TO PROVIDE THE REQUIRED SECURITY WILL RENDER THE BIDDER NON- RESPONSIVE AND THE BID WILL NOT BE ACCEPTED, OPENED OR READ ALOUD. IN ADDITION, FAILURE TO PROVIDE THE REQUIRED SUBCONTRACTOR INFORMATION AT THE TIME OF BID OPENING MAY RENDER THE BIDDER NON- RESPONSIVE”.
