ADVERTISEMENT FOR BIDS

 

Name of Project:      Job Order Contracts (JOC); Regions 1, 2, & 3 (Downstate), Region 6, Region 7, Region 8

Project Description:  A Job Order Contract is a competitively bid, indefinite quantity construction contract pursuant to which the Contractor may perform an ongoing series of individual Job Orders up to or totaling the Maximum Annual Contract Value. The bid documents include a Construction Task Catalog® containing Pre-priced Tasks for construction work with preset Unit Prices. All Unit Prices are based on local labor, material and equipment costs and are for the direct cost of construction.

 

The value of the Price Proposal shall be determined by summing the total of the following calculation for each Pre-priced Task: Unit Price x quantity x Adjustment Factor, plus the value of all Non-Priced Tasks. The Job Order Price shall equal the value of the approved Price Proposal.

 

Regions 1, 2 & 3(Downstate) - D013545 contract covers: Nassau, Suffolk, Bronx, Kings, Queens, Richmond, New York, Rockland, Putnam, and Westchester Counties. The contract end date is December 31, 2025.  The Contract may be amended or extended for a maximum of four additional one year periods. The contract has a Minimum Contract Value of $0 and a Maximum Annual Contract Value of $1,800,000.

 

Region 6 - D013533 contract covers: Herkimer, Oneida, Lewis, Jefferson and St. Lawrence Counties. The contract end date is December 31, 2025.  The Contract may be amended or extended for a maximum of four additional one year periods. The contract has a Minimum Contract Value of $0 and a Maximum Annual Contract Value of $1,500,000.

 

Region 7 - D013534 contract covers: Oswego, Cayuga, Onondaga, Madison, Tompkins, Cortland, Chenango, Tioga and Broome Counties. The contract end date is December 31, 2025.  The Contract may be amended or extended for a maximum of four additional one year periods. The contract has a Minimum Contract Value of $0 and a Maximum Annual Contract Value of $1,500,000.

 

Region 8 – D013535 contract covers: Orleans, Genesee, Monroe, Wayne, Livingston, Ontario, Seneca, Yates, Steuben, and Chemung Counties. The Contract end date is December 31, 2025. The Contract may be amended or extended for a maximum of four additional one year periods. The contract has a minimum Contract Value of $0 and a Maximum Annual Contract Value of $2,000,000.

 

All bidders must attend a mandatory virtual Pre-Bid Conference. The Pre-Bid Conference is for the purpose of discussing the JOC concept, Contract Documents, the New York State Department of Environmental Conservation JOC program, bid considerations, answering questions and discussing JOC from a Contractor's viewpoint (including how to calculate a bid).

 

Time and location for conference: On May 6, 2025, 10:00am, the Department will host the mandatory Pre-Bid Conference virtually, via Zoom videoconferencing. All bidders are responsible for ensuring they provide the Department with email address(s) and other required information to attend the Conference. The Department will provide, via email, a link to access the Zoom Meeting to all plan holders. Attendance at the Conference will be recorded. Failure to attend the Pre-Bid Conference may result in your bid being considered non-responsive and may result in elimination from further consideration.

 

Drawings, specifications and proposal forms for this Project are available in electronic format at no charge. In accordance with State Finance Law §143, hard copies may be purchased for a fee of $25.00 from the Bureau of Maintenance & Technical Services, 625 Broadway, 3rd Floor, Albany, NY 12233-5254. Individual checks for each project shall be made payable to the New York State Department of Environmental Conservation. Sealed proposals will be received by the New York State Department of Environmental Conservation, Bureau of Procurement and Expenditure Services, 625 Broadway, 10th Floor, Albany, NY 12233-5027, until 11:00 a.m. on May 13, 2025.

 

Proposals will be accepted only from bidders who purchase contract documents from the Department. All proposals must be made on the official Proposal Form 004113 and enclosed in an envelope. Each proposal must be accompanied by a deposit or a Bid Bond Form 004313 in the amount of $25,000. The Apparent Low Bidder will be required to submit a completed NEW YORK STATE VENDOR RESPONSIBILITY QUESTIONNAIRE FOR-PROFIT CONSTRUCTION (CCA-2) and M/WBE-EEO & SDVOB Utilization Plans, within 24 hours and five days respectively, of being notified that they are the Apparent Low Bidder.

The Contractor shall adhere to the NEW YORK STATE DEPARTMENT OF ENVIRONMENTAL CONSERVATION GUIDELINES REGARDING PERMISSIBLE CONTACTS DURING A PROCUREMENT AND THE PROHIBITION OF INAPPROPRIATE LOBBYING INFLUENCE.

Appendix A of the contract contains Standard Clauses for all NYS Contracts; Appendix B contains Standard Clauses for Department of Environmental Conservation contracts including MBE and WBE requirements; Appendix C contains Standard Clauses for Ethics in all NYSDEC Contracts; and Appendix D contains Participation Opportunities for New York State Certified Service-Disabled Veteran Owned Businesses (SDVOB).

 

Subcontractors will be required to complete the New York State Vendor Responsibility Questionnaire For-Profit Construction (CCA-2).  There are maximum subcontracting limits as specified in the Supplemental Instructions to Bidders.

 

In accordance with Labor Law, §220-h, all contractors’ employees shall be certified as having completed an OSHA 10 safety training course.

 

The Department of Environmental Conservation reserves the right to reject any or all bids.  The Successful Bidder will be required to furnish a Performance Surety Bond and a Labor and Materials Surety Bond, each for 100% of the amount of the contract. The Successful Bidder will be required to provide Policies of Insurance as set forth in the Contract Documents.
